Prenup / BFA DIY Kit
A starter template and step-by-step guide for preparing your own draft binding financial agreement. It's a starting point only - your agreement won't be enforceable until each of you has received independent legal advice from your own lawyer.
What's in the kit
This kit is aimed at couples who want a proper starting draft rather than a blank page, before deciding whether to add independent legal advice now or later.
- A prenup / binding financial agreement template document, for you to complete with your circumstances
- A plain-English, step-by-step preparation guide
- A completion checklist, including the independent legal advice step each of you still needs to take
Starting price: from $149. That price gets you the template, guide and checklist only - it doesn't include the independent legal advice each of you will still need before the agreement has any legal effect. Many people use the kit to get a draft together quickly and affordably, then upgrade to have that advice arranged.
Why a template on its own isn't enough
A binding financial agreement is different from most of our other document-prep products. Under the Family Law Act, it doesn't take effect just because you've both filled it in and signed it - each person needs independent legal advice, from a separate lawyer, about how it affects their rights and its advantages and disadvantages, before it becomes binding. That requirement applies whether you use this kit, our full-service option, or draft something entirely yourselves. See our full binding financial agreement page for the option that arranges that advice for you.
A binding financial agreement, whether it's a prenup or a postnup, only takes effect once each person has received independent legal advice, from their own separate lawyer, about how it affects their rights and its advantages and disadvantages. This kit gives you a template and guidance to prepare a draft - it is not legal advice, and the completed document is not enforceable on its own. You can upgrade at any time to have an independent family lawyer in our network review your draft and arrange that advice for each of you.
