Many people use the kit to get a draft together quickly and affordably, then upgrade to have that advice arranged.

Why a template on its own isn't enough

A binding financial agreement is different from most of our other document-prep products. Under the Family Law Act, it doesn't take effect just because you've both filled it in and signed it - each person needs independent legal advice, from a separate lawyer, about how it affects their rights and its advantages and disadvantages, before it becomes binding. That requirement applies whether you use this kit, our full-service option, or draft something entirely yourselves. What's included in the DIY Kit?
A binding financial agreement template document, a plain-English step-by-step guide, and a completion checklist. It's a starting draft and guidance product - it doesn't include independent legal advice for either of you.
Is the finished document legally binding once we sign it?
No, not on its own. A binding financial agreement, prenup or postnup, only becomes enforceable once each of you has received independent legal advice, from your own separate lawyer, about how it affects your rights and its advantages and disadvantages. Filling in and signing a template without that advice does not make it binding, and it can be set aside later if you skip this step.
Can we add independent legal advice later?
Yes. You can upgrade to our full-service option at any time - just get in touch, and we'll arrange an independent family lawyer in our network for each of you to review your draft and give that advice.
Is this the same as drafting a prenup completely on our own?
It gives you a proper starting point rather than a blank page - our template and guide are built specifically around what a binding financial agreement needs to cover under the Family Law Act. But whether you use our kit or draft from scratch, the same rule applies: it isn't enforceable until each of you has your own independent legal advice.
