What is a property settlement?

A property settlement is the formal division of assets, debts and superannuation between two people who've separated - houses, savings, vehicles, shares, super, and anything else you own together or separately. Once you've agreed on the split, it still needs to be properly documented and, depending on your situation, formalised through the courts so it holds up over time.

It doesn't cover contested settlements or complex asset pools - trusts, self-managed super funds, or business valuation disputes. If your situation includes any of that, we'll tell you honestly and point you to a family lawyer who handles matters of that kind.

There's no fixed formula - a court (or an agreement reached without going to court) generally looks at what you both own together and separately, what each of you contributed financially and otherwise, and what each of you will need going forward.
